US Court Says AI-Generated Art Cannot Have Copyright

A U.S. appeals court ruled that artwork created by artificial intelligence (AI) without human input cannot be copyrighted. The decision supports the U.S. Copyright Office, which said only works with human authors can get copyright protection.

The case involved Stephen Thaler, whose AI system “DABUS” created an image. Thaler applied for copyright in 2018, but the Copyright Office rejected it in 2022. A federal judge later agreed, saying human authorship is a key requirement for copyright.

Other artists have also tried to copyright AI-generated images made with the tool Midjourney. Unlike Thaler, they argued they helped create the images and should get copyright.

Thaler plans to appeal the ruling, but the Copyright Office believes the court made the right decision. The case highlights ongoing debates about AI and copyright in the growing field of generative AI.
